By accessing and using our moving logistics planning services, you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

2. Services Description

We provide professional moving logistics planning services including residential moves, commercial relocations, storage solutions, and packing assistance. All services are subject to availability and may vary based on location and specific requirements.

3. Booking and Payment

Services must be booked in advance. A deposit may be required to secure your booking. Final payment is due upon completion of services unless otherwise agreed. We accept various payment methods as specified at the time of booking.

4. Cancellation Policy

Cancellations must be made at least 48 hours before the scheduled service date to receive a full refund of the deposit. Cancellations made less than 48 hours in advance may be subject to cancellation fees. Please refer to our Return Policy for detailed information.

5. Liability and Insurance

We maintain comprehensive insurance coverage for all moves. However, clients are responsible for declaring valuable items and ensuring adequate coverage for high-value belongings. Our liability is limited as outlined in our service agreements.

6. Client Responsibilities

Clients are responsible for:

  • Providing accurate information about items to be moved
  • Ensuring access to both pickup and delivery locations
  • Being present or designating an authorized representative
  • Securing necessary permits or permissions if required

7. User Obligations and Prohibited Uses

When using our services, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Use our services only for lawful purposes
  • Comply with all applicable laws and regulations

You are prohibited from:

  • Using our services for any illegal or unauthorized purpose
  • Attempting to gain unauthorized access to our systems
  • Interfering with or disrupting our services or servers
  • Transmitting viruses, malware, or harmful code
  • Impersonating others or providing false information
  • Violating any intellectual property rights

8. Intellectual Property

All content on our website and in our services, including text, graphics, logos, images, software, and other materials, is the property of Glowlightart or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, or create derivative works from our content without permission
  • Use our trademarks or logos without written consent
  • Remove or alter any copyright or proprietary notices

You retain ownership of any content you submit to us, but grant us a license to use, modify, and display such content in connection with providing our services.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • Our total liability for any claims arising from our services shall not exceed the total amount paid by you for the specific service in question
  • We are not liable for any indirect, consequential, incidental, special, or punitive damages
  • We are not liable for loss of profits, data, business opportunities, or goodwill
  • We are not responsible for delays or failures due to circumstances beyond our reasonable control

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Glowlightart, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of our services
  • Your violation of these Terms of Use
  • Your violation of any rights of another party
  • Any content you submit or transmit through our services

11. Service Modifications and Availability

We reserve the right to:

  • Modify, suspend, or discontinue any aspect of our services at any time
  • Update or change our services without prior notice
  • Impose limits on certain features or restrict access to parts of our services

We do not guarantee that our services will be available at all times or that they will be error-free. We may perform maintenance that temporarily interrupts service availability.

12. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including:

  • Violation of these Terms of Use
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • At our sole discretion

Upon termination, your right to use our services will cease immediately. Provisions that by their nature should survive termination will remain in effect, including payment obligations, indemnification, and limitation of liability.

13. Dispute Resolution

If a dispute arises between you and Glowlightart, we encourage you to first contact us directly to seek a resolution. Our contact information is provided in Section 15.

If we cannot resolve the dispute through direct communication, the following applies:

  • Mediation: Parties agree to attempt mediation through a mutually agreed mediator before pursuing legal action
  • Jurisdiction: Any legal proceedings shall be conducted in the courts of New Zealand
  • Governing Law: These terms are governed by the laws of New Zealand

14. Changes to Terms

We reserve the right to modify these Terms of Use at any time. We will notify you of material changes by:

  • Posting the updated terms on our website with a new "Last updated" date
  • Sending an email notification to registered users
  • Displaying a prominent notice on our website

Your continued use of our services after such changes constitutes acceptance of the updated terms. If you do not agree to the changes, you must discontinue use of our services.

15. Severability and Waiver

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

16. Entire Agreement

These Terms of Use, together with our Privacy Policy and other policies referenced herein, constitute the entire agreement between you and Glowlightart regarding the use of our services and supersede all prior agreements and understandings.
